General Terms and Conditions (AGB)
- Scope
These General Terms and Conditions (AGB) apply to all orders placed through our online shop by consumers and entrepreneurs.
- Consumer refers to any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity.
- Entrepreneur refers to a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
For entrepreneurs, if they use contrary or additional general terms and conditions, these are hereby rejected and will only become part of the contract if explicitly agreed upon by us.
- Contract Partner, Conclusion of Contract, Correction Possibilities
The purchase contract is concluded with Advanced Food AG.
The presentation of products in the online shop is not a legally binding offer, but an unverbindlicher (non-binding) online catalog. You can initially add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided in the checkout process. By clicking the order button, you submit a binding offer for the products in the cart. The confirmation of receipt of your order will be sent via email immediately after you submit the order.
We accept your offer within two days by:
- Sending an acceptance statement in a separate email,
- Delivering the goods,
- Or by processing the payment transaction through our service provider or the chosen payment service provider. The processing time for the payment transaction depends on the selected payment method.
- Contract Language, Contract Text Storage
The language available for contract conclusion is German.
We store the contract text and send you the order data and our terms and conditions in text form. You can view the contract text in your customer login.
- Delivery Conditions
In addition to the prices for products, shipping costs apply. You will find the exact shipping costs during the checkout process.
We only ship the goods and do not offer pickup options.
We do not ship to pack stations.
- Payment
In our shop, the following payment methods are available:
- Prepayment: We will provide our bank account details via a separate email, and delivery will occur after payment is received.
- PayPal, PayPal Express: To pay via PayPal, you must be registered with PayPal, log in with your credentials, and confirm the payment. The payment will be processed immediately after the order is placed.
- PayPal Plus: We offer additional PayPal services. You can use PayPal even without registration.
- Right of Withdrawal
Consumers have the legal right of withdrawal as described in the withdrawal policy. Entrepreneurs are not granted a voluntary right of withdrawal.
- Retention of Title
The goods remain our property until full payment has been made.
- Transport Damages
For consumers: If goods are delivered with obvious transport damages, please report these damages immediately to the carrier and contact us as soon as possible. Failure to file a complaint or contact us does not affect your legal rights, including warranty rights.
- Warranty and Guarantees
The statutory warranty rights apply unless explicitly stated otherwise.
For entrepreneurs: The warranty for new items is limited to one year from the transfer of risk.
- Liability
We are liable for damages caused by us, our legal representatives, or agents in the event of injury to life, body, or health, or in cases of gross negligence.
- Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration body.
- Youth Protection
If your order includes goods with age restrictions, we ensure through a reliable procedure, including a personal identity and age verification, that the customer meets the required minimum age. The delivery will only be made after age verification and will be handed over personally to the customer.
- Final Provisions
If you are an entrepreneur, German law applies, excluding the UN Sales Convention (CISG).
For merchants, legal entities under public law, or public law special funds, the exclusive jurisdiction for all disputes arising from contractual relationships between us and you is our business location.
